What is Probate?
Probate is the official process of validating a Will. This includes ensuring that the deceased person's Will is, in fact, valid. An inventory of the deceased's property must be taken, as well as having the property appraised, paying any debts and taxes, and distributing the remainder of the assets in accordance with the Will or the state law in the event there is not a Will.
Usually, you need an attorney like Linda C. Plum to make court appearances. The attorney's and court fees would be paid from estate property.
What if I Don't Have a Will?
If you don't have a Will, someone must be appointed by the court to serve as the personal representative. This person is usually the closest capable relative to the person who has passed away.
